Law enforcement broadly refers to any system by which some members of society act in an organized manner to promote adherence to the law by discovering and punishing persons who violate the rules and norms governing that society. Although the term may encompass entities such as courts and prisons, it is most frequently applied to those who directly engage in patrols or surveillance to dissuade and discover criminal activity, and those who investigate crimes and apprehend offenders. Furthermore, although law enforcement may be most concerned with the prevention and punishment of crimes, organizations exist to discourage a wide variety of non-criminal violations of rules and norms, effected through the imposition of less severe consequences. From Google Video Search: "enforceable" Is a non-compete clause enforceable if the original owner sold the company and there is now a new owner/name? Q. My husband signed a non compete clause with his employer 5 years ago. Last August the employer sold the business and the company name changed. No new contract was signed with the new owner. Is the non compete clause still enforceable? We live in Oregon. Asked by travisli - Tue Feb 3 15:01:20 2009 - Other - Business & Finance - 3 Answers - Comments A. Technically, yes it is still in force. Non-compete agreements are generally enforceable in the case of a statutory merger or stock sale. Indeed, in the case of a statutory merger, the new entity or employer is the successor to the rights and liabilities of the original employer, and notwithstanding the law of assignments, the non-compete agreement remains in full force and effect after the merger, or sale. That said, the non-compete may be unenforceable after 5 years. Non-competes must be based upon the former emplyee having confidential information (such as margins, techniques, or customer lists), that would give the former employee an unfair advantage in competing with the former employer. If that is no longer the case, which would… [cont.] Answered by patrick - Tue Feb 3 15:14:57 2009 Are stop signs in parking lots in Wisconsin enforceable?
Q. I have been looking online and cannot find the answer. Does anyone know if stop signs in grocery stores, shopping centers, department stores, etc are enforceable? Asked by The New Girl - Wed Aug 5 15:07:04 2009 - Law Enforcement & Police - 3 Answers - Comments A. By state law, they are not enforceable. That is covered under State Statute 346.02(1). However, they may be covered under local ordinance. As long as the municipal government recognizes the signs, you can still be held accountable. In these cases, you are issued an ordinance violation. Because it is not a state law, the violation does not get reported to the DMV, so it does not show on your driving record nor is it available to insurance companies. Another consideration is other laws that may apply. In Wisconsin, there are three moving violations that can be enforced in private parking lots as long as they are open to the public. They are reckless driving, hit and run, and drunk driving. Therefore, if you run a stop sign at a high rate of… [cont.] Answered by Bruce - Wed Aug 5 15:31:57 2009 From Yahoo Answer Search: "enforceable" |

@ Cornell Books Store: Cornell Books Price: $68.55 USD • Compare Prices ► Condition: used Restraint of Trade is an accessible examination of the law relating to restraint of trade between employers and employees. It explains how restrictive covenants work in practice, both during and after employment. The author first examines express clauses, looking at the six principal problems which may be faced when considering whether a covenant potentially in restraint of trade is enforceable or not after termination of employment: Does the clause protect a legitimate proprietary interest which will normally be a trade secret or trade connection? Is the clause reasonable between the parties? Is the clause reasonable in the public interest (an issue not normally relevant in employment law)?If part of the clause is invalid, may it be severed? How is the covenant to be construed? If the term is valid, which remedy or remedies may the employers obtain? The author then goes on to consider covenants during employment, implied terms both during and after employment, various drafting tips, and the effect of the Transfer of Undertakings (Protection of Employment) Regulations 1981. With coverage of the definition of particular words in the covenant, the consequences of invalidity of a clause, and the effect of wrongful dismissal, Restraint of Trade will be a useful reference for practitioners of employment or contract law, in-house lawyers, company secretaries and human resource managers.
